Outdoor Activity Agreement

The person signing this agreement is going to join the outdoor activity, taking place

at______________, planned to start on______________and finish on______________.

The customer should be aware that Sim's Cozy Travel is only responsible for making arrangements with the activity organiser____________________on behalf of the customer. The partner company is responsible for everything else, including all activity arrangements (equipment supply and preparation, permits, safety precautions, etc.)

Participant Responsibility:

•  1.The participant understands that outdoor activities, including mountain-climbing, hiking, rock-climbing, ice-climbing and any other similar activities, are dangerous and unpredictable accidents could happen at any time. The participants agree to take the risk and responsibility on themselves, and join of her / his own volition.

•  2.The participant is aware of the environment in which the activity takes place, and also knows what skills, physical abilities and equipment are necessary to complete the activity. The participants have to be sure that they are able to take part in the activity.

•  3.The participants are responsible for the equipment prepared by themselves.

•  4.Participants have to be healthy, since the activity is both physically and mentally challenging. Anyone who hides an illness unsuitable for outdoor sports, such as encephalon, pulmonary, and acrophobia, contagion, mental illness, hemorrhoids, etc. will be held the responsible for any consequence of that illness.

•  5.Outdoor sports are team activities. The participants should be cooperative with other team-members and should not be proud, panic, etc. The participants must obey the organizer's arrangement, otherwise they will be held responsible for any consequence of their actions.

•  6.Outdoor activities require the proper environment, suitable weather and good climbing technique, and only when all these conditions are satisfied are you able to carry on. These requirements are very complicated, and may prevent the activity from taking place. The organizer has the right to stop the activity according to the environment and personal conditions; participants should be prepared for this. When the organizer decides the activity must finish, the team will withdraw and anyone who continues is responsible for the consequences of their actions.

•  7.Participants should know that the organizer tries their best to give the correct instructions and ensure the safety of the participants. They are not responsible for the actions of a participant who does not follow the rules written on this agreement, who does not correctly understand what they are doing, or who mis-uses the equipment.

•  8.If any additional costs occur (for any reason) during the activities, such as an extension of the itninerary due to illness or bad weather, participants will have to discuss with Sim's Cozy Travel and the organiser to determine who is financially responsible.

•  9.Participants must not do anything to harm the local enviroment, or the folk customs and culture of the people in the area in which the activity is held.

•  10.Some unforseen situations, such as emergency rescue, may cause extra cost. If an accident is caused by personal behavior, he/she take the full responsibility. If no one person is to blame, all participants will share the cost.

Sim's Cozy Travel's Responsibility:

•  1.Sim's Cozy Travel is responsible for making arrangements with a properly registered company, which has the licenses necessary to organize outdoor activities.

•  2.Sim's Cozy Travel is responsible for providing the details and the information given by the mountain activity organizer, and to give advice to the participants so that the activity may be completed smoothly.

•  3.Sim's Cozy Travel is not required to judge if the participant is fit enough to take part in the activity.

•  4.Sim's Cozy Travel has to make sure that activity organizer is responsible for any damages or loss caused by guide's wrong decision or organizer's wrong arrangement. If a participant goes against the advice of a guide, then this person is responsible.

•  5.Sim's Cozy Travel has to make sure that the activity organizer is responsible for the condition and safety of the equipment they provide or prepare.

•  6.Sim's Cozy Travel has to make sure that the activity organizer is responsible for the loss of equipment caused by improper organisation.

•  7.If the participant requires insurance, Sim's Cozy Travel can assist them in this matter. It is the only guarantee Sim's Cozy Travel can provide.

This agreement is valid after signature and payment, and expires automatically when the activity is finished. The right of explanation of this agreement belongs to Sim's Cozy Travel.
